These Terms & Conditions ("Terms") govern your use of memoir, including the memoir mobile application, related app extensions, website, and support pages (together, the "Service"). The Service is provided by Mohammad Elzahaby ("memoir", "we", "us", or "our").
By downloading, accessing, or using memoir, you agree to these Terms. If you do not agree, please do not use the Service.
1. What memoir does
memoir is a private journaling app for writing entries, saving memories, attaching optional media, recording voice notes, setting prompts and reminders, reviewing reflections, and optionally syncing your library with your personal iCloud account.
memoir is intended for personal journaling and reflection. It is not medical, psychological, legal, financial, or professional advice.
2. Your content
Your journal entries, images, audio recordings, transcriptions, moods, locations, prompts, and other content that you create in memoir remain yours. You are responsible for the content you create, import, store, or share through the Service.
You agree not to use memoir in a way that violates applicable law, infringes another person's rights, or stores content that you do not have the right to use.
3. Local storage, iCloud, and backups
memoir is designed to store your journal data on your device first. If you enable iCloud Sync through memoir+, your data may be stored in your personal iCloud account and synced across Apple devices signed in to that iCloud account. iCloud is provided by Apple and is subject to Apple's terms and privacy policy.
If you export or import backups, you are responsible for storing backup files securely. Backup files may contain your private journal content and attachments.
4. memoir+ subscriptions
memoir may offer optional auto-renewable subscriptions under the name memoir+ ("Subscription"). Available Subscription options may include memoir+ Monthly and memoir+ Yearly. The features included in memoir+ are shown in the app before purchase and may include features such as images, audio, custom fonts, prompts, reflections, and iCloud Sync.
Payment is charged to your Apple Account when you confirm the purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your Apple Account may be charged for renewal within 24 hours before the end of the current period. You can manage or cancel your Subscription in your App Store account settings after purchase.
Prices, subscription periods, and available plans are shown by the App Store before purchase and may vary by country or region. If the App Store offers a trial, introductory price, or promotional offer, the specific terms shown by the App Store apply.
memoir cannot issue refunds for purchases charged through Apple. Refund requests are handled by Apple according to Apple's policies.
If you cancel a Subscription, you keep access to paid features until the end of the current paid period. If a Subscription expires, some memoir+ features may become unavailable, but your existing journal content remains yours.
5. App Store terms
Downloads, purchases, subscriptions, refunds, family sharing availability, and payment processing are handled by Apple through the App Store. Your use of the App Store is governed by Apple's Media Services Terms and other applicable Apple terms.
6. Permissions and device features
memoir may ask for permission to use device features such as notifications, camera, photo library, microphone, speech recognition, location, Spotlight search, and device authentication. You can control these permissions in iOS settings. Some features may not work if permission is denied.
7. Intellectual property
The memoir app, website, design, name, logos, text, software, and other materials are owned by Mohammad Elzahaby or licensed to us and are protected by intellectual property laws. These Terms do not transfer ownership of memoir or its intellectual property to you.
We grant you a personal, limited, non-exclusive, non-transferable licence to use memoir for your own lawful, personal use, subject to these Terms and Apple's App Store rules.
8. Updates, changes, and availability
We may update, change, suspend, or discontinue parts of the Service at any time. We may also release updates to maintain compatibility with Apple platforms, improve security, fix bugs, or change features.
We do our best to keep memoir reliable, but we do not guarantee that the Service will always be available, uninterrupted, error-free, or compatible with every device or operating system version.
9. Third-party services
memoir relies on Apple services and frameworks for features such as iCloud, StoreKit subscriptions, App Store lookup, notifications, device authentication, location, speech recognition, Vision text recognition, and Spotlight indexing. Those services are provided by Apple and may be subject to Apple's own terms and privacy practices.
10. Disclaimer
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
Nothing in these Terms limits any consumer rights, warranty rights, or other rights that cannot be excluded under applicable law.
11. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, loss of profits, loss of goodwill, or business interruption arising from your use of the Service.
Nothing in these Terms excludes or limits liability where exclusion or limitation is not permitted by applicable law, including liability for intent, gross negligence, personal injury, or mandatory consumer protections.
12. Termination
You may stop using memoir at any time. We may suspend or terminate access to the Service if required by law, if the Service is discontinued, or if you materially violate these Terms.
13. Governing law
These Terms are governed by the laws of Austria, without prejudice to any mandatory consumer protection laws that may apply in your country of residence.
14. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new effective date. If you continue using memoir after the Terms change, the updated Terms apply to your continued use.
